After the Bankruptcy Reform Act in 2005 the law now requires that you must take an approved "CREDIT COUNSELING COURSE" prior to filing for bankruptcy. If this course has not been taken prior to filing your bankruptcy petition, your case will be dismissed. The cost of this class is approximately $50.00 depending on which company you use. This class usually lasts about 30 minutes.
After your petition for bankruptcy has been filed you are also required to take a 2nd class called "After Bankruptcy Class In Financial Management" The cost of this class is approximately $20.00 per person. If this is a joint case husband and wife can take the class together but you will need to have separate certificates. This class usually lasts about an hour.
You can take these bankruptcy classes over the internet in our office or at your home. If you take these bankruptcy classes outside of our office make sure all the bankruptcy class certificates are faxed to us at (804) 358-7985 so that we may file the certificates with the bankruptcy court. Call our office at 804-358-2222 to make sure we have received them.
There are a number of approved agencies that offer the credit counseling classes. We typically use a company called
HUMMINGBIRD CREDIT COUNSELING AND FINANCIAL MANAGEMENT.
